London: The Supreme Court has cleared the way for Dr. Badri KC to resume his duties as the president of the Non-Resident Nepali Association (NRNA).

The Supreme Court issued its final verdict on Tuesday after hearing a writ petition filed by four individuals, including Krishna Prasad Timilsina, the association’s co-treasurer, representing the International Council elected from the NRNA’s 11th general convention.

A joint bench of Supreme Court Justices Tilak Prasad Shrestha and Tek Prasad Dhungana nullified the Foreign Ministry’s letter that had barred Dr. Badri KC’s executive committee from functioning.

Following the verdict, Dr. KC stated that the ruling has paved the way for the executive committee elected from the 11th general convention to function fully. He noted that the committee elected from the 11th general convention had faced injustice due to disputes related to the 10th general convention. He said, “Today’s decision by the Supreme Court has opened the way for the elected committee to work. We will start working actively from tomorrow,” in an interview with nepalbritain.com.

Timilsina’s team had filed a writ petition requesting a mandamus order to prevent any disruptions or obstacles to the functioning of the International Coordination Council elected from the 11th International General Convention for the term 2023-2025.

Previously, in April, a bench of Supreme Court Justices Sapana Pradhan and Dr. Nakul Subedi had annulled the multiparty system established during the NRNA’s 10th general convention and ordered former president Shesh Ghale to conduct elections within six months. However, due to ambiguity regarding executive authority, Timilsina had approached the Supreme Court.

The full text of the decision by Justices Pradhan and Subedi had not been made public for an extended period, complicating the dispute within the association further. It was only last Tuesday that the full text was presented in Bench No. 7.
